Proposal, not final law
In July 2026, the European Commission proposed extending the EU Emissions Trading System to municipal waste incineration and co-incineration. The proposal sets out a phased pathway beginning in 2031, but it must pass through the EU legislative process before becoming final.
That distinction is essential. Market participants can prepare for the direction of travel without presenting proposed dates or design features as settled obligations.
Why the market is watching
A carbon cost can affect gate fees, contracts and the relative economics of landfill, recycling, energy recovery and cross-border movement. The effect will vary with facility emissions, national policy and contractual allocation of carbon costs.
The policy debate also considers leakage: changing the price of one treatment route can redirect material elsewhere if other routes are not addressed coherently.
What suppliers can do now
Reliable information about fossil carbon content, composition and destination will become increasingly valuable. Supply chains should review how samples are taken, how results are shared and how change is managed over a contract period.
